This Acceptable Use Policy ("AUP") governs use of Webapps LLC's software products, services, and infrastructure, including HitPath, Portable Stats, Track My Pets, and any associated platforms ("Services"). By accessing or using our Services, you agree to comply with this AUP. Failure to comply may result in suspension or termination of your account and access.
1. Overview
Webapps LLC provides technology solutions to the performance marketing industry. This AUP is designed to protect the integrity and security of our platform, our clients, and the broader internet community. All users — whether clients, affiliates, or visitors — are bound by this policy.
2. Prohibited Activities
You agree that you will not use our Services to:
- Violate any applicable local, state, national, or international law or regulation.
- Engage in any fraudulent activity, including click fraud, ad fraud, or invalid traffic generation.
- Transmit unsolicited bulk email (spam) or other mass communications without recipient consent.
- Distribute malware, viruses, worms, spyware, or any other malicious code.
- Attempt to gain unauthorized access to any system, network, or account.
- Interfere with or disrupt the integrity or performance of our Services or related systems.
- Collect or harvest personal data without proper authorization or in violation of applicable privacy laws.
- Impersonate any person or entity or falsely represent your affiliation with any person or entity.
- Engage in any activity that could expose Webapps LLC or its clients to legal liability.
- Promote, facilitate, or engage in any activity related to hate speech, harassment, or discrimination.
- Use the platform to track, target, or collect data on individuals under the age of 13.
- Reverse engineer, decompile, or disassemble any part of our software or services.
- Resell, sublicense, or redistribute access to our Services without express written permission.
3. Traffic Quality Standards
Because our platform is specifically designed for performance marketing, all traffic run through HitPath-powered campaigns must meet industry standards for quality and legitimacy. The following types of traffic are strictly prohibited:
- Bot or automated traffic not disclosed to and approved by the network
- Incentivized traffic without proper disclosure and network approval
- Traffic generated through misleading, deceptive, or false advertising
- Traffic from prohibited geographies as defined in individual campaign terms
4. Data Use and Privacy
All data processed through our Services must be collected, stored, and used in accordance with applicable privacy laws, including but not limited to GDPR, CCPA, and COPPA. You are responsible for ensuring that:
- You have all necessary rights and consents to collect and process the data you submit to our platform.
- You maintain an accurate and up-to-date privacy policy on your own properties.
- End user data is handled with appropriate security measures.
- Data is not used in ways inconsistent with the permissions granted by the data subject.
5. Security Obligations
You are responsible for maintaining the security of your account credentials and any access tokens or API keys issued to you. You must notify Webapps LLC immediately at support@hitpath.com if you suspect any unauthorized access to your account or any security breach.
6. Content Standards
Any content, creatives, or offers promoted through our platform must comply with applicable advertising laws and guidelines, including FTC regulations. Content must not be false, misleading, deceptive, or otherwise violate applicable consumer protection laws. Content promoting illegal goods or services is strictly prohibited.
7. Reporting Violations
If you become aware of any violation of this AUP, please report it to us at support@hitpath.com. We take all reports seriously and will investigate promptly.
8. Consequences of Violation
Webapps LLC reserves the right to investigate any suspected violation of this AUP. Depending on the nature and severity of the violation, we may:
- Issue a formal warning
- Temporarily suspend your access to our Services
- Permanently terminate your account
- Report the violation to appropriate law enforcement authorities
- Pursue civil remedies including injunctive relief and damages
9. Modifications to this Policy
Webapps LLC reserves the right to modify this AUP at any time. We will provide notice of material changes via registered email or by posting the updated policy to our website. Your continued use of our Services following notice of any changes constitutes your acceptance of those changes.
